Terms of Service, Public Offer and Refund Policy
Effective date: upon publication. This document is a public offer within the meaning of Articles 633, 641 and 642 of the Civil Code of Ukraine. It governs use of fexsmm.com and the Telegram bot @fexsmm_robot, placement of orders, account top-ups, payments, refunds and support.
1. Provider and acceptance
The Service is operated by 4go.tech, identification code 421235122224, address: 131 Pyrohova Street, Vinnytsia, Ukraine (the “Provider”). Any person who uses the website or the Telegram bot, creates an account, adds funds or places an order (the “User”) accepts this offer, the Privacy Policy and the rules displayed in the Service. Acceptance is full and unconditional. The agreement is concluded electronically in accordance with the Law of Ukraine “On Electronic Commerce”. If the User does not agree, they must stop using the Service.
2. Service
fexsmm.com and @fexsmm_robot (together, the “Service”) are an online platform for ordering digital and social-media-related services. The order form on the website or in the bot shows the scope, price, limits, estimated completion time and applicable conditions of each service. The Provider may change, suspend, replace or discontinue services, suppliers, prices and limits at any time. An order is accepted only once the Service has recorded it and the required payment is confirmed.
3. User duties and prohibited use
The User must provide accurate information and keep the account and Telegram credentials secure. The User must submit only lawful content and must hold the necessary rights and permissions for every link, account, username, text, image or other material submitted. The User must comply with the legislation of Ukraine, other applicable law and the rules of the relevant social network or platform.
It is prohibited to use the Service for:
- illegal, fraudulent, deceptive, abusive, defamatory, extremist, hateful or pornographic content;
- terrorist, gambling, narcotics or weapons content;
- copyright-infringing or privacy-infringing content;
- content that justifies, denies or glorifies the armed aggression against Ukraine.
It is also prohibited to impersonate another person, manipulate elections, evade sanctions (including sanctions imposed by Ukraine), abuse payment systems, or submit third-party payment details without authorization.
The Provider may refuse, pause, cancel or limit any order and may restrict an account. It may also retain or return funds as required by law, payment-provider rules or fraud-prevention procedures.
4. Orders and delivery
The User is responsible for selecting the correct service, quantity, link and other order data. An order may be irreversible once processing begins. Delivery estimates are not guarantees. Results may vary, be delayed, partially delivered or reversed. They may also be affected by social networks, platforms, suppliers, maintenance, technical failures, moderation, algorithm changes or other third parties. The Provider does not guarantee any particular number of views, followers, likes, plays or level of engagement. Nor does it guarantee ranking, reach, retention or any business result. The Provider does not guarantee that an account or content will not be restricted, removed or blocked.
If the Provider cannot complete an order, it may cancel the order or credit an eligible unused amount to the User’s internal balance. Any remedy is limited to the amount actually paid for the undelivered part of the order. This limit is subject to mandatory law and the refund rules below.
5. Prices, balance and payments
Prices are displayed before payment in the currency indicated in the Service and may change for future orders. The internal balance is a prepaid amount for use within the Service. It is not a bank account, deposit, investment or electronic money account. Unless mandatory law requires otherwise, balance funds cannot be exchanged for cash and may be used only for orders.
Payments are processed by third-party payment providers. They may be subject to those providers’ terms, verification, limits, currency conversion and fees. The User authorizes the Provider and the relevant processor to process the payment and carry out fraud checks. The User must not use stolen, unauthorized or third-party payment instruments.
6. Refunds
Except where the consumer protection legislation of Ukraine or other mandatory law provides otherwise, a top-up or payment is non-refundable once the funds have been credited or an order has entered processing.
Cryptocurrency and crypto-wallet payments. Payments made in cryptocurrency or through a crypto-wallet are non-refundable. They cannot be returned to another wallet or converted into cash. If a service cannot be delivered, the Provider may, at its discretion, credit the internal balance or provide another remedy available under the Service rules. This restriction does not exclude rights that cannot lawfully be excluded, such as remedies for the Provider’s proven non-performance or for a payment made in error.
Fiat payments. If an eligible service is not delivered or is materially not provided, the Provider may approve a refund of the affected amount. Fiat refunds may be available for payments made by bank card, Google Pay, Apple Pay or another supported fiat method. Refunds are made only to the original payment method or the original verified payment details, never to unrelated third-party details. Processing may take up to 14 banking days after approval, and the payment processor or acquiring bank may take additional time.
Where legally permitted, the Provider may deduct payment-processor, acquiring, currency-conversion and administrative costs from the refund, up to 17% of the relevant payment. Only costs actually charged or reasonably attributable to the transaction may be deducted. No deduction is made where mandatory law prohibits it. The User must contact support promptly and provide the order or payment ID and any information reasonably required for verification.
Refunds are not available for:
- completed or correctly delivered services;
- unused balance where the User has simply changed their mind;
- orders with inaccurate links or order data;
- cases where the User has violated these terms;
- platform restrictions caused by the User;
- unauthorized use of an account;
- fees charged by the User’s bank or wallet.
Where fraud, money laundering, chargeback abuse or unauthorized payment is suspected, the Provider may suspend the account and investigate before processing a refund.
7. Chargebacks and payment disputes
The User must first contact support to resolve a genuine service or payment issue. The User must not submit a false or abusive chargeback claim. Nothing in this document prevents the User from exercising non-waivable rights. In the event of fraud or an unjustified payment reversal, the Provider may:
- suspend the account;
- cancel pending orders;
- recover documented costs;
- provide relevant transaction information to the payment provider or a competent authority.
8. Intellectual property and user materials
The website, the Telegram bot, software, design, text, trademarks and databases belong to the Provider or its licensors. The User grants the Provider a limited right to process submitted materials, only as necessary to provide, secure and support the ordered service. The User confirms that the materials do not infringe third-party rights. To the extent permitted by law, the User will compensate the Provider for losses arising from claims caused by the User’s materials, instructions or unlawful use.
9. Availability and liability
The Service is provided on an “as available” basis. The Provider is not responsible for:
- interruptions, internet failures and power outages;
- cyberattacks and payment-provider failures;
- changes to social networks or their APIs, moderation and account restrictions;
- supplier failures;
- loss of expected profit, loss of data, or indirect or consequential loss;
- force majeure, including martial-law measures, and other events outside its reasonable control.
Nothing in this document excludes or limits liability that cannot lawfully be excluded under the legislation of Ukraine. This includes liability for intentional breach of obligations and mandatory consumer rights.
To the maximum extent permitted by law, the Provider’s aggregate liability for a specific order is limited to the amount paid for that order. The User must take reasonable steps to mitigate loss. Nothing in this section affects a refund expressly approved under Section 6.
10. Suspension and termination
The Provider may suspend or terminate access, cancel orders or require verification where:
- the User breaches this document;
- the User creates risk or uses the Service unlawfully;
- the User threatens the Service or other users;
- a payment provider, platform or the law requires it.
Termination does not remove payment obligations or provisions that by their nature must survive.
11. Privacy and communications
Personal data is processed under the Privacy Policy. The User agrees to receive operational notices about orders, payments, security and support by email, through the Service or via @fexsmm_robot. Marketing communications are sent only where the law permits. The User may refuse them through the available unsubscribe method or by blocking the bot.
12. Complaints and support
Support: info@fexsmm.com and @fexsmm_robot. A request should include:
- the account email or Telegram username;
- the order or payment ID;
- the date and amount;
- a description of the issue.
The Provider may request identity, payment and transaction information to prevent fraud.
13. Changes, severability, language and governing law
The Provider may update this document by publishing a new version. The version that applies to an order is the one accepted before that order was placed, unless the law requires otherwise or the change applies only to future orders. If any provision is invalid, the remaining provisions stay in effect, and the invalid provision is limited only to the extent necessary. If this document is published in several languages and the versions differ, the Ukrainian version prevails. This document is governed by the legislation of Ukraine, subject to any mandatory rights and protections that apply to the User. Disputes are resolved by the competent courts of Ukraine, subject to mandatory consumer-jurisdiction rules.
